Access Attaché Online Website Terms and Conditions
These Terms and Conditions apply to the use of the Access Attaché Online website, located at www.attacheonline.com, to retrieve and view documents electronically delivered via the Access Attaché document delivery service.
The following terms have specific meaning under these Terms and Conditions:
"Sender" is a person or organisation who uses the Access Attaché document delivery service to send Documents.
"Receiver" is a person who has registered to use the Access Attaché Online website.
"Document" is a business communication created by a Sender and then passed to the Access Attaché document delivery service for electronic delivery to the recipient(s) specified by the Sender.
Ownership and copyright
Attaché Software Pty Ltd (trading as Access Workspace) and its associates are the owners and copyright holders of the Access Attaché Online website. Under these Terms and Conditions, you have the non-exclusive right to use Access Attaché Online website to retrieve and view Documents.
Document retrieval and viewing
Documents are available for retrieval and viewing on the Access Attaché Online website for a period of at least 12 months from the date the Document is received by the Access Attaché document delivery service for delivery to the nominated recipient(s), and may remain available for as long as 7 years.
Access Attaché reserves the right to remove Documents from the Access Attaché Online website within three months of the Sender ceasing to use the Access Attaché document delivery service.
To retrieve and view documents, Receivers must have access to the internet and appropriate software and hardware to view websites, such as a computer with an internet browser or a compatible mobile device.
Contact the Sender if you do not want to receive documents via the Access Attaché document delivery service.
Authentication of documents
The content of each Document sent by Access Attaché document delivery service is controlled by the Sender of the Document. As such, Access Attaché is not responsible for the content of Documents.
It is the responsibility of the Receiver to authenticate Documents delivered by the Access Attaché document delivery server and available on the Access Attaché Online website.
Limit to the service
Access Attaché's role is strictly limited to the sending, tracking, storage and retrieval of business Documents. Access Attaché has no responsibility for how these are used by the Receiver.
It is acknowledged that the Internet is a public communications medium over which neither party has any control. The time taken for the delivery of Documents can therefore not be guaranteed.
This agreement is governed by the laws of New South Wales, Australia, or the laws of New Zealand where applicable.
When a Sender uses the Access Attaché document delivery service to deliver a Document, the Sender supplies Access Attaché with the Receiver’s email address. The Document and the associated email address are securely stored by Access Attaché for the purpose of enabling access to the Document by the Receiver and for the Sender to verify the status of the Document delivery. The Receiver’s email address is not used for any other purpose.
No Liability for damages and indemnity
So far as is permissible by law, Access Attaché shall not be liable to the user for any injury, damage or loss suffered by the user or any servant, agent or invitee of the user arising out of the use or misuse of the Access Attaché document delivery service. Under no circumstances can Access Attaché be held liable for events that occur outside its control.
